This website is operated by YBP Digital Media Management Private Limited under the brand name Yellowbus Photography. These standard Terms and Conditions given in this website shall govern your use of the website for placing any order for availing our services. The cost and functioning of all products not provided by Service Provider in rendering Services hereunder, including, but not limited to electric power, furniture, site etc. shall be Client’s sole responsibility. You must read agree and accept the following terms and conditions before proceeding to avail any of our services
1. Services:
1.1. We agree to provide photography services with reasonable care and knowledge.
1.2. If you have any particular requirement with respect to the photography, you agree to let us know while booking in some cases, the additional requirements might charge more.
1.3. By booking a session with us you agree to the given Terms and Conditions and agree to proceed on the basis of the same. You are not entitled to any kind of refund in case you don’t like the style or quality of the photo. We reserve the right to delete any photographs which we do not consider to be unnecessary or poor quality.
1.4. During a photography session you agree to comply with all of our reasonable directions and we will not be subjected to detailed instruction from you as to how to complete the project. However, we will consider any specific request during the photography session.
2. Prices:
2.1. The price of every package varies from each other and depends upon various factors such as the distance, location, number of photos, quality of photograph etc.
3. Booking Deposit and Payment:
3.1. All the bookings shall be confirmed when we send a confirmation through emails after you pay the required deposit and the same is confirmed by us. We may make provisional booking for a photo session but no booking is guaranteed or reserved until you pay the deposit in full.
3.2. We reserve the right to cancel any booking for any reason.
3.3. The 50% of the total amount for the session shall be considered as deposit. The said deposit shall be received by us three days prior to the said photo shoot. The remaining amount shall be paid within 7 days of delivering the final photographs.
3.4. All payments shall be made through online/cash. The bank details shall be shared in the invoice
3.5. Title on all the work will remain with us until you make the complete payment
4. Cancellation and Rescheduling:
4.1. You can reschedule your appointment through sending a mail. This reschedule needs to be done 72 hours prior to the photo shoot.
4.2. If you cancel a reserved booking your deposit will be forfeited and you will not be repaid.
4.3. If the shoot is an outdoor one. We shall not repay the amount in case of bad weather. However, we shall find suitable alternative for the same to complete the shoot.
4.4. We reserve the right to cancel any session immediately when you are uncooperative, abusive to any of us or any of our employees or contractor When we cancel the shoot for the above-mentioned reasons, your deposit will not be returned.
5. Intellectual Property Right:
5.1. We will retain all the intellectual property including but not limited to website contents, Trademarks, codes, images, logos etc. Any inappropriate use of the above-mentioned intellectual property rights shall be considered as a penal offence and the offender shall be prosecuted under the appropriate law.
5.2. We shall have the right to use the logos and Trade names of our clients on our website, or otherwise in any material prepared by us for advertisement purpose.
5.3. We will be entitled to display any of the photos or albums we have taken for you in the gallery section of our website or social media. We might also use the photos for our own marketing purpose.
6. Customer Online Photos:
6.1. The photos of our customers available online are strictly for viewing purpose. Those images are not to be saved, used published or circulated without prior consent is an offence and shall be punishable under the prescribed law.
7. Liability:
7.1. We shall not be held liable for any kind of property damage or any kind of financial loss or for any kind of incidental or consequential damages such as lost profit, lost account, lost opportunity, lost bargain, whether caused by our or our employees or contractors’ negligence or otherwise.
7.2. Our total liability will be limited to the amount paid to us. We will not be liable to any other party, other than the person who has made the booking.
7.3. You shall be held liable if any of our equipment are lost or damaged and such loss or damage is the result of your negligence or deliberate act or omission.
7.4. Nothing in these terms will exclude our limit or liability for death or personal injury caused by our negligence.
8. Force Majure:
8.1. We can’t be held liable for not completing the project in case of occurrence of any event which includes but not limited to earthquake, tsunami, flood, pandemic etc which makes the completion of the project impossible on our part.
8.2. In the event of cancellation of the project because of the above-mentioned reasons, we will refund the amount.
9. Privacy Policy:
9.1. While using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name (“Personal Information”).
9.2. Like many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics.
